Terms and Conditions
For the purpose of this document Southern Auction Solutions – will be known as “Auction Company”.
- “As is”, “Where is” NO WARRANTY. All items are sold “As is”, “Where is,” without guarantee of any kind. The descriptions of items appearing in advertising prior to this auction are believed to be correct. Nevertheless, neither those descriptions nor any oral statements made by the Auction Company (or their agents or officers) concerning any item shall be construed as a warranty, either expressed or implied.
I, the Bidder, have examined this merchandise and accept it the way it is. It is solely the responsibility of the Bidder to inspect and examine the items to be sold, and to ask any questions if necessary. Bidder should be satisfied as to the condition of the items to be sold prior to, bidding.
The Auction Company has disclosed all that it is aware of about each item; however, it is the Bidder’s responsibility to inspect the item prior to placing a bid. All sales are final with no returns.
Neither Auction Company nor the Seller make any guarantees whatsoever concerning the items to be sold.
- Buyer’s premium – There will be a 10% Buyer’s Premium added to the high bid price as the Auction Company’s commission.
- Inspections and Equipment Needed- The Auction Company recommends you inspect the item prior to bidding. Descriptions are believed to be correct but are not guaranteed to be so. If you are not available to inspect the item, we further suggest you contact a local professional to perform an inspection on your behalf. The item will be made available for inspection as requested.
Any equipment needed to load items for pick-up or shipping will be the responsibility of the Buyer. Neither the Auction Company nor the Seller are liable for load out.
- Bill of Sale- We will provide a Bill of Sale/Invoice after payment is received.
- The Issuing of Title- Any item which has been issued a title in the past will come with a title after the auction unless disclosed as not having a title. It is the Bidder’s responsibility to inquire if the transaction documents being provided are satisfactory for their state. Ownership and transaction documents vary from state to state and the Auction Company does not guarantee ownership document acceptance outside Alabama. This is the Bidder’s responsibility.
The title will be provided at the time of the pick-up. The Seller will maintain possession of the title until that time.
- Tax Except- Dealers that are tax except must provide proof of their exception to the Auction Company. We must have this documentation on file in the event of an audit. If you fail to present proof of your exception you will be required to pay sales tax.
- Pick up- Times for pick up will be arranged between the Auction Company and the Seller. Once payment is received the Auction Company will provide the information to arrange pick-up.
- Storage- Storage fee will be in the amount of $25.00 per day and will charged starting 14 days from the close of the auctions. The Auction Company or their employees are not responsible for any damage to any item.
- Shipping- Shipping will be the responsibility of the Buyer.
- Payment- Wired funds are the only expectable form of payment. The wire must be received by our bank by the first Friday after auction closes at 4 pm CST. Wiring instructions will be included in your invoice after the close of the auction. Preauction offers will be considered.
- Wire Fee- There is a $15.00 fee added to your invoice for the wire fee charged by the bank, unless the wire is originating outside the U.S. Outside the U.S. the wire fee is $16.00.
- International Bidders- Any and all charges for phone calls outside the United States, will be billed to the Bidder and added to the total invoice.
Any additional wire fee charges- Will be billed to the international bidder and added to their invoice.
- Abandonment- Any item not picked up within 30 days becomes the property of the Auction Company with no refund to the buyer.
